KFC‘s 4P strategy in China Essay

1. Product In order to bring success in China, KFC knows that western restaurants need changed by using localization strategy. As cultural adaptation is the process of â€Å"adjusting the native ways of thinking and behaviors to be consistent with the local culture† (Kotler, 1982), KFC tends to launch Chinese food apart from western food like burger or chicken wings, for examples, Chinese food like congee and rice, and promote Chinese herbal tea in 2004. KFC launched Chinese products like ‘Wolfberry Pumpkin Congee’, ‘Chicken Porridge with Mushroom’, ‘Duck Soup’, even lunched the ‘Deep-fried dough sticks’ in 2008. 90% of its raw materials are coming from the local too. It is obviously that KFC is trying to create the Chinese taste food when it entering to China market. The Chinese food fit the local taste and it helps KFC to build up the relationship with the Chinese people. Also, KFC introduced several new products with Chinese regional characteristics aiming to adapt local taste. For instance, ‘Dragon Twister Combo’, ‘Sichuan taste Spicy Chicken’, ‘Cantonese flavor cushion chatter’, etc. As there are many cities in China, KFC wants to treasure different regional tastes, from Beijing to Sichuan or Cantonese tastes. The products that are particularly designed for the Chinese, which gives the chance to KFC promoting their brand to Chinese people and becomes the first western fast food restaurant with Chinese cuisines in China. While KFC has launched diversification products, no matter western food like burger, French fries, chicken wings, or Chinese food like congee, rice, soup, deep-fried dough sticks, etc. People can find different types of food in KFC and it introduces a new product every half month in average, which provided an innovative product lines to customers and enlarge its market in China. 2. Place KFC is the first joint vendor of international fast food shop in China and its first restaurant is located in Tiananmen Square (Beijing) in 1987. ‘Perhaps not surprisingly the first KFC outlet had strong novelty value and attracted huge queues and custom.’ (Jim Riley, 2013) It is no doubt that KFC is enjoying the first mover advantage and it attracts Chinese to taste a  freshness western restaurant. KFC has more than 4000 outlets in the Chinese market and in every province of China. It covers the major large and medium sized cities like Beijing, Guangzhou, Tianjing, etc. KFC wants to expand its market share in China with a remarkable speed and it identified 16 key cities as its base. Also, it use a strategy to expand its market from the big cities to the medium and small cities. To create a demand of its brand in the big cities, then extend into the medium and small sized cities. KFC started out gaining notice in bustling cities like Beijing, Guangzhou, Shanghai as big cities tend to be the capital cities with larger customer based and higher level of economy development. It helps KFC to establish its brand image in China while marketing in big cities can help KFC to test the local market with the macro environment and market conditions of fast food industry and less chance of failure for KFC to enter Chinese market. Moreover, KFC choose the locations with large traffic and pedestrian volume which are always near to the supermarkets, gasoline service stations or shopping malls. There is a unique feature that KFC applying for its distribution system, which helps to expand its store network. KFC owned their outlets rather than only franchised them in China with building warehouses and operating a fleet of trucks. It provides extensive staff and management training including from food preparation to customer service and logistics. This special distribution system gives KFC greater control over their outlets and ensure its quality of services. 3. Promotion KFC is using the localization strategy to adapt local taste in their promotion. It changed its slogan into Chinese cultural version from ‘We do chicken right’ to ‘,’ in 2005 and ‘’ in 2010. This action shows the ambition of KFC is to establish a strong image of pleasing Chinese. With the purpose of motivating the brand awareness and sales volume to targeted customer like family with children, KFC launched several gift promotions which followed the Chinese comic trends. For example, the cartoon named ‘Pleasant Goat and Big Big Wolf’ is extremely hot and popular, KFC promotes its children sets with the doll gift of the cartoon. This helps to boost the sales volume of its child food set and making a trend to Chinese children to collect KFC gift collections. Also, in order to build up the  customer loyalty of children in China, KFC creates its own cartoon named ‘QiQi’ and opens a website (Miaoli City http://www.kfckids.com.cn/) for children to play. Furthermore, the promotion sells union of people in its advertisement, which promoting KFC is a good place for every groups of people to have their reunion time. It can easily find that KFC is creating a pleasant image for families and friends while Chinese is focusing on relationships. 4. Price KFC is using the price skimming strategy towards its customers in China. As KFC is targeting middle to high levels class in the big and medium sized cities first, it sets its price in a relatively high in the beginning. The average price for personal meal in KFC is around 30RMB which is higher than the other restaurants in China. But, KFC lower its product price with promotion and discount provided after. Most of its sets have at least 3 dollars discount and KFC gives discount to every new product. Also, online coupons are extremely high usage in China which attract many Chinese having their meals in KFC. For instance, a dinner set with priced 20RMB can be decreased to 15RMB when customers downloaded the coupon online and gave it to the cashier. The tea set is cheap to attract more customers in the normal hours. For example, a tea set with egg tart and dessert cost 6 dollars only. Apart from the discount, differentiate pricing policy is applied in KFC. With different cost in different outlets or stores in different places, there are different pricing of KFC products. While the economic environment is not the same in each region, the cost used in different KFC restaurants are different namely the rent. Racial and Criminal Profiling: a Deductive Argument Essay

Erin Callihan, AIUSA, states that â€Å"Increased national security should not equate to decreased civil liberties. All people are entitled to due process and other basic human rights and constitutional protections† (Amnesty International). Racial Profiling, according to Amnesty International, occurs when race is used by law enforcement or private security officials, to any degree, as a basis for criminal suspicion in non-suspect specific investigations. The Constitution, which is arguably the most important document of the United States, clearly states that every person has the rights to life, liberty and the pursuit of happiness. This document sets the American people apart from many other countries in that it is supposed to give us equal rights. An issue that has risen in the United States time and time again and has threatened this equality is that of race and racism. Now in law enforcement from the levels of your local police department to that of prestigious FBI units there is the specialization in profiling, racial profiling to be more exact. Racial profiling has not only proven to be largely unsuccessful, but it is violating our equal rights ending up in over representation in America’s prisons and discrimination in the real world. Race is a socially constructed form of categorization that has often been misunderstood, leading to different forms of racism. It is a set of shared interests, characteristics, and culture. Race is an illusion that has been created to construct identity. Identity is not totally decided by you, but chosen for you by what people have decided about you. The way that people see other people and things as right or wrong depends on the culture you, the individual, is living in. This then makes identity as something that is mostly cultural. Race is like a stereotype, or over generalization, that is making prejudices that lead to racism. A prejudice is any preconceived opinion without correct or adequate information. Through something that is socially constructed through culture, like race, Race is difficult to measure and apply to people because it is self identified. According to Ailya Saperstein and Andrew M. Penner in their article â€Å"The Race of a Criminal Record: How Incarceration Colors Racial Perceptions†, â€Å"Most research on race in the United States treats race as an intrinsic characteristic of individuals, a fixed group membership ascribed at birth and based on one’s ancestry† (93). This is difficult to put into use in the real world because if you have one idea of what each race is you will find that people are different depending on where you are, the time period you are there, the amount of interaction with other cultures, and the history in that land among many other variables. An example of this would be how I was considered to be really Mexican at UCSB, yet I am considered â€Å"White washed† by my family, and I consider myself to be a combination of both as well as Colombian. As having been grown up first generation American it is very hard on me to have been Latina. When I studied abroad last year in Argentina I was not considered Latina at all, but White. The Argentine had a different perception of race and insisted that it didn’t matter where your parents were from, it only mattered where you were born. The majority of the population does not fit into only that one mold most researchers have put them in. Race is affected by the population in power and as such can be seen as a form to keep the status quo. The minorities in a society are often the ones that have a negative reputation and have to deal with the social construct others have made about them. Examples of minorities would be Blacks, Latinos and Muslims. The three races have faced a lot of scrutiny here in the United States. They have been accused of being a large part of the crime population, being uneducated, and being terrorists. Although most are not this is the stereotype they have to live with every day. When you are part of the majority you get to make up your own identity, which usually ends up being positive. When you are part of the majority, in the case of the United States this would White, it usually means you a doing well or better than others socially. Other things associated with Whites would be a higher education and the suburbs. As the dominant culture all the laws that are created have had them in mind. Racism is institutional prejudice and as such it is hidden. Therefore in order to be racist I would argue you need to be part of the dominant culture. There is a misrepresentation in the incarceration is an example of racial profiling as being unconstitutional. The majority of the population of incarcerated rates is made up of Blacks and Latinos. Can it be that they are truly a crime committing race and since Whites are educated they perform less than half the crime? The answer to this is no. African Americans have long been subjugated to felons since the history of the United States began. They were seen as lowly and uneducated and convicted of crimes they did not commit. Unable to fight back due to the fact that no one would listen or care even if they knew they were wrong they had to endure punishment. It is a fact that if you are part of the dominant culture the punishment will be less severe. The thing about the Rodney King incident that enraged people was not whether he was guilty or not it was the manner in which he was prosecuted. He was beaten severely unfairly without being able to have a trial to see if he was guilty. In the eye of the law you are â€Å"innocent until proven guilty†, and Mr. King was never given a fighting chance. Another example of discrimination through racism would be the immigration law in Arizona that â€Å"requires police officers, â€Å"when practicable,† to detain people they reasonably suspect are in the country without authorization and to verify their status with federal officials† according to Randall C. Archibold of the NY Times (par. 22). How is a person reasonably suspect of being an illegal? This is done those physical features. The fourteenth amendment provides protection against unreasonable searches based on race. Is this law not an example of that? Saperstein and Penner argue that racial profiling, through incarceration rates, affects the individuals, families and communities (93-94). If we start from the top we see that Latinos and Blacks do not constitute even half of our government making it misrepresentative of our population. One way racial profiling affects the individual is by making it harder for them to obtain a job, let alone a well paying job. Sometimes the individual has to work at a young age to help their parents with rent and other necessities. This is why we see and therefore associate Latinos and Blacks in low income neighborhoods. Once you are part of the minority and have been incarcerated the odds of you succeeding in life get significantly slimmer. According to Saperstein and Penner if you have been incarcerated for something narcotics related then you are disqualified for a lot of the aid the government offers. In your FAFSA application you are asked if you have been convicted of any drug related felony. If you press yes then you are not eligible for financial aid. Since most of these families cannot afford to send their children off to college that option completely diminishes. As a result you have communities with low income, who are most educated to the high school level, if that with high unemployment. Let’s put aside the fact that racial profiling goes against the constitution and look to see if it actually works. According to sources the FBI’s use of criminal profiling has a low success rate. Their success rate can be equaled by that of psychics some would argue. Captain Ron Davis of the Oakland Police Department said it best in September 9, 2003 to NOBLE when he stated that â€Å"Racial profiling . . . is one of the most ineffective strategies, and I call it nothing less than lazy, sloppy police work. It’s basically saying you don’t want to learn about your community, you don’t want to learn about people’s behavior, you don’t want to do your job, and don’t want to investigate, you just want to stop a lot of people and see if you can come up with some statistical number at the end of the evening. . . .†. (Amnesty International) There has been criticism on the process because essentially what you are is forgetting about the hard evidence and guessing up a picture of what the perpetrator looks like. Profilers have forgotten was fieldwork is and have become armchair professionals that don’t need to go to the crime scene to get insight. In Macolm Gladwell’s What the Dog Saw he describes the job of a profiler as relying on typology to paint a picture of the killer. Most of reasoning behind this technique is that of homology, the relationship between the culprit and the action. Gladwell noticed that there were two categories of killers, organized and unorganized. The organized chose their victim carefully and went through great measures to not be caught. The disorganized killer chose their victim randomly with usually high stakes of being caught. Gladwell finds out that people don’t fall strictly into one category therefore crimes don’t fall into one category. You can have the same crime done for different motives. By relying on connections they are making up based on theories they have made up that have made this guessing game that Gladwell calls a â€Å"party trick† (354). The moral of his story being in a way like Einstein’s in that if you get enough wrongs you eventually get a right. However, there is too much a stake, one of these being people’s lives, to play a guessing game at that level. Racial profiling and Criminal profiling are unconstitutional and frankly a waste of time. Racial profiling opens the door and accepts discrimination to uphold the status quo. Criminal profiling is a waste of time, tax dollar money and obscured by racial profiling. However, there existed no law to protect the Blacks, which made Massachusetts to take advantage and pass a statutory that declared all Blacks as slaves and forbid intermarriage with the Americans. It was until the year 1963 during the biggest ever demonstration in the history of America with about 250,000 people that segregation ceased a bit. It resulted in major gains for the blacks in education, social life, politically, legally and economically (â€Å"FAQs† web). In the year 1964, an act was passed that outlawed discrimination in public facilities. In addition, an anti- poverty law that ensured equal employment rights to all Americans and voting rights act were passed (â€Å"FAQs† web). Before this, there were diverse schools for the blacks and others for the whites and no white would join a Black school or vice versa. With the passing of these laws, racial segregation of public schools was unconstitutional and any black or White child had a right to join a school of their choice. Besides the fight yielding equal educational opportunities for the blacks, it attained curriculum provisions. For the first time in history, curriculum included courses that taught the history of Black Americans as well as their contribution to the Americans history, the fruits. However, this did not last long because the Whites sent their children to private schools, reducing the prestige of public schools. The quest of inadequate education is not yet over since most Blacks cannot take their children to private schools. Does Racism affect Education Today? Black segregation remains, which has affected the education systems to date. Although decent housing is a basic right in America, many black Americans have to put up with poor housing because of unfair treatment. Some of the Black Americans can afford better housing but racism and bending of the law blocks them out. Therefore, they have to join their poor counterparts and rent houses in the ghettos with poor neighbourhoods. Apparently, housing is a major cause of educational differences between the poor and the rich. It is clear that the Blacks and the whites live in distinct neighbourhoods and thus attend nearby public or private schools. This has fostered differential treatment between the black schools and the Whites schools, reducing young Blacks’ chances to quality education and good jobs. For instance, a visit to a well-off public or private schools will lead to spotting up-to-date textbooks, comput ers, VCRs, and numerous curriculum activities to round out their education. On the other hand, public schools in the inner or poor estates use old textbooks, old equipment, and no special programmes. Realism theory is different from liberalism and postinternationalism. Liberalism promotes the freedom to pursue economic gain, liberty to participate in the affairs of public life, respect for political human rights, and minimal government. Postinternationalism comes from the presumption that accelerating change and deepening complexity are the major tendencies at work in the world. Realism, liberalism, and postinternational polaics paradigms have some common elements but they also rest on different and contradictory, premises. Hans Morgenthau (1948) first expounded a theory on international relations which explained the past and current events and which will be the likely direction and shape of future relations. Morgenthau's ideas is similar to writings on world politics and represented continuity with the past. The realist approach stems from Thucydides, the chronicler of the ancient Peloponnesian War, who wrote, "The strong do what they have the power to do, the weak accept what they have to accept." Thucydides pushed for a first-class navy and the wealth of empire gave an edge to Athens. (Thucydides, 1978). It was "the growth of Athenian power and the fear this caused in Sparta" that, in Thucydides' opinion, caused the war. The fact of Athenian power and the fact, known to his readers, that Athens ultimately lost the war creates a terrible tension in his book. (Robert Connor, 1984). Athens, a powerful state lost the war because it overextended itself and fell victim to its own sense of grandeur. Its ci tizens forgot the necessity for moderation and denigrated the virtues of taking justice as well as advantage into their political calculations. Power, as expressed in ships and money, and the moral character of the warring cities accounted for the final outcome of the war.Power holds the two strands of realism that have evolved in the modern era. Traditional realism, which evolved in the 1930s and in the post-World War II period, is a form of realism grounded in a view of human nature. It points out that humans are self-interested, rational, and seek power; qualities that lead to the consistent, regular behavior of states. Traditional realism holds that we live in "a world of opposing interests and of conflict among them, moral principles can never be fully realized, but must at best be approximated through the ever temporary balancing of interest and the very precarious settlement of disputes." (Buzan, et.al., 1984).Neorealism or structural realism, highlights the structure of the international system rather than human nature to account for the behavior of states. Social Unrest in the Bahamas Essay The principal causes of working class unrest and increasing dissatisfaction were the same throughout the British Caribbean Region colonies: low wages; high unemployment and under-employment; arrogant racist attitudes of the colonial administrators and employers in their relations with black labourers; lack of adequate and proper, in most cases, any representation; and no established structure for the resolution of industrial disputes by collective bargaining. Furthermore the unfairness shown towards black labourers would later result too many complaints and little or no positive response. Black labourers continued to seek some kind of equality due to the fact that most of their work at the same performance level as those who were white. ? Political Struggles: The Bahamas, like many other countries that are apart of the Commonwealth, had representative assemblies based on the bicameral system of the mother country. Each colony had a governor who represented the monarch, an appointed upper house, and an elected lower house. The electoral franchise, however, was extremely restricted, being vested in a few wealthy male property holders. Colonial acquisition and administration were not neatly and easily accomplished. The Burma Road riot, however, was more than an isolated act of venting. Although a powerful symbol of black agency that has been referenced again and again in the political struggles of Bahamian blacks, the riot was more than a symbol. The riot also kindled the development of a pro-black consciousness in the country, a necessary precursor to black rule and independence. The majority black population in the Bahamas could literally dismantle the edifices of minority white rule, if sufficiently provoked. The fissure that was created in 1942 would widen over the next few decades and within a quarter of a century it became a gapping hole that the majority black Progressive Liberal Party (PLP) walked through to victory. ? ? High unemployment and under-employment: By the early nineteenth century, blacks constituted at least 80 percent of the population in the Bahamas. Majority falling in the unemployment or the under-employment category. Around this time whites were considered more qualified leaving most blacks with little work options. For example, middle class blacks had a better chance to receive a well paying job than any equally qualified ‘grass root’ Bahamians. ? Racism: Even after emancipation, Caribbean societies inherited a rigid racial stratification that was reinforced by the unequal distribution of wealth and power. The three-tier race structure, which existed well into the 1940s and in some societies beyond, upheld the belief of European racial superiority, although most West Indians are of African descent. Racial discrimination was prevalent throughout the Bahamas in the 1930s and the 1940s. Black Bahamians were treated as subhuman in this country. It appears as if the suffering of the black masses, which were mostly living in abject poverty. For example, in the general strike in 1958, white taxi drivers were granted license to transport tourist from the newly opened airport located on Windsor Field. This started began the ‘Quiet Revolution’ which was gave the Progressive Liberal Party (PLP) a chance bring the issues of the nation in the presence of the House of Assembly. Low Wages: Black labourers were reluctant to work but were mostly given low wages. Blacks were paid less than white labourers which began uproar in most cases. The government was forced to impose martial law (where the police are given extra powers to arrest) and establish curfew fearing that the black labourers would take out their frustration on local whites. In relation to racism, foreign workers were paid 8 shillings per day versus shillings for local workers (Burma Road riot). Although many have suffered discrimination in many ways, this seems to be the most effective and injustice of them all. Bahamians were willing to work but they were unwilling to remain submissive to the white government or merchant class order. This was because of the difference of wages between black Bahamians and the merchant class order. The white government tried to negotiate the improvement of the wages, however, the Bahamians still suffered from the discrimination. Things such as owning a property was difficult because they never met the outstanding payment due to low wages. Foreign workers were paid more than black locals; overlooking the fact that the some black locals work harder to be paid that the small amount of money. In conclusion, during the nineteenth century, common causes of working class unrest were extremely obvious because of the many riots and the constant discrimination against blacks and whites. The inequality of each factor represented how Bahamians suffered to find a job that would offer them a respectable a wage and to muster their strength to create a political party that can proudly present the frustrations of the black Bahamians in the House of Assembly. Black Bahamians wanted to elevate black people to a position of racial equality and to promote democratic values for all Bahamians. Successfully the Bahamas looked forward to an outstanding future. The black majority party (PLP) won the government making Lynden Pindling the first black Premier of the Bahamas. Sir Milo Butler became the first Governor General of the Bahamas. The Bahamas has greatly improved since the 1930s and the 1940s. The country didn’t face anymore labor discrimination and most importantly racial tension. The Bahamas grew even more and hadn’t faced any more struggles and strife. The 1930s and the 1940s were forever engraved in the Bahamian history because it was a time that the Bahamas had to fight for what was theirs in pride and strength. 1. In November 1957 the government had once again betrayed us by granted license to white taxi drivers to transport tourists from the newly opened airport at Windsor Field. We were not going to tolerate this injustice act us Taxi Cab drivers. So we all came together and planned to use our Taxi cabs as blockade across the road leading to the airport. It seemed risky but it was worth it. The question â€Å"What was I thinking? † lingered in my mind for a couple of days but I had to do it for the sake of my family, my colleagues, my job, and my country. The strike officially began in January of 1958. We formed a blockade with our vehicles across the road lading to the airport exactly like we had planned. Many other workers came outside to support us as well. The leader of the Bahamas Federation of Labor and a known heroic figure, Randol Fawkes, called for all hotel workers, sanitation workers, government workers, teachers and public servants to strike, in order to force the government to address the labor issues of the country. The General Strike was to last sixteen (16) days. Bay Street owned tour companies were given the exclusive right to transport tourists to and from the hotels. Obviously, this move, if allowed to go unchallenged, would have destroyed the livelihoods of hundreds of black Bahamian independent taxi drivers. The General strike was a peaceful, non-violent revolution of the labor laws of this country. The strike had its intended outcome. New labor laws including the Trade Union and Industrial Conciliation Act were passed. A labor department was set up giving ordinary workers more rights. Discriminatory labor practices were also banned. The black majority got a right to vote. In 1959 all Bahamian men over were allowed to vote. In 1961 legislation was passed that allowed women over 21 to vote. As Bahamians we struggle to get what we want but it was a strong fight to what we deserved. Life had changed ever since then all because we didn’t tolerate the racial attitudes and unfairness of the white government.

Blake v DPP, a summary of criminal case law Introduction In addition to the general defences seen in criminal law (duress, coercion, diminished responsibility etc) the offence of criminal damage has a number of specific defences which are found in the Criminal Damage Act 1971. In particular section 5 (2) states that a defendant has a lawful excuse, if: He believed that the person whom he believed entitled to consent to the destruction or damage of the property would have consented, had he known of the circumstances; or he acted ‘in order to protect’ the property of himself of another, or a right or interest in property that the property, right, or interest was in immediate need of protection, and the means adopted were reasonable, having regard to all the circumstances. This defence has been used in a number of cases that will be dealt with below. The leading authority on the defence is Blake v DPP[1]. However, one must look at the law prior to this judgement and after it. Prior to Blake In R v Ashford[2] it was held not top be a lawful excuse for the defendants to cut the wire at an airforce base in order protest against the use of nuclear weapons even if they subjectively believed that they had a lawful excuse to act. Michael Jefferson states that the ‘defendants argued that the reduction of the risk of the use of nuclear weapons would protect property in England because the risk of retaliation would be reduced.’[3] It was an already viewed as an objective test that the courts employed. R v Hill[4] involved the defendants cutting a wire fence in order to prevent nuclear war. The Court of Appeal held that the act of cutting was too remote from the prevention of nuclear war and they confirmed that it was an objective test rather than a subjective test. Jefferson notes that the property was not in ‘immediate need of protection’ and so it did not matter that the defendants believed they were acting to protect ‘property belonging to another’. Blake v DPP The defence would apply if the defendant honestly believes X is the owner and consents, even though X is not the owner. However in Blake v DPP, the Divisional Court rejected the defendant vicar’s argument that he believed that God owned the property and had consented to the damage. The court acknowledged that his belief was sincere it was however impossible to produce any evidence other than the defendant’s own belief that the command was in fact given. If this defence was indeed accepted then the defence could be raised regarding murder where the accused could simply claim he was carrying out the intentions of God. His marker pen graffiti on the Houses of Parliament in protest against the Gulf war was held to be unlawful. The defendant also claimed that he had a lawful excuse under section 5 (2) (b) as he damaged the pillar in order to protect property in the Gulf States. The Divisional Court held that, even if the defendant had believed that he had a lawful excuse, the court needed to adopt an objective view, if on the facts believed by the defendant, what was done by him protected, or was capable of protecting property. Richard Card states that the offence was to protect the property in the Gulf States; as such protection was too remote from his conduct[5]. Card states that this objective requirement read into s 5 (2) (b) is not easily reconcilable with the words of the statute, which seem to be a clear expression of a test that is solely subjective. Post Blake The case of Chamberlain v Lindon[6] showed that the defence has some success. This case deals with a ‘right of way’ as the accused was held to be protecting it when he demolished a wall. This was held to be in an ‘immediate need of protection’ as it was being obstructed and it would continue until litigation resolved the case. R v Kelleher[7] involved a defendant who knocked the head off a statue of Baroness Thatcher in a protest regarding the policies of democratic governments (UK and USA). The defendant believed that these policies made the world a more dangerous place to live in and would lead to the destruction of the world. The defendant was convicted but then appealed on two grounds. First, he stated that the ruling of the judge that the defence of ‘lawful excuse’ was not available was wrong. Secondly, the judge wrongly directed the jury to return a verdict of guilty. Regarding the first issue, the court held that the trial judge was correct in deeming the defence of lawful excuse as unavailable to the defendant. Regarding the second ground for appeal, William Priestley states that as the jury was invited to retire after the judge’s direction, this showed that the jury had in fact acted independently as they then returned and delivered a verdict of guilty.[8] In Jones v Gloucestershire Crown Prosecution Service[9] the defendants relied on section 5 (2) (b) as they damaged property at RAF Fairford in order to protest at illegality of the war in Iraq. These acts were done in order to preserve the homes of their family and friends. It was held that none of the defendants could reasonably believe that their actions of cutting wire around an RAF base would protect their homes. Conclusion As we have seen the defence of s 5 (2) has been used by a number of defendants. Its use has been primarily used by individuals protesting against the policies of the government. With the Human Rights Act 1998 cementing the European Convention of Human Rights into the UK legal system, Article 10 and 12 will be relied on in order to give individuals the right of assembly and free speech. This right however does not extend to criminal acts of damage against property. The objectivity that surrounds s (5) (2) shows that defendants will find it increasingly difficult to rely on this defence however compelling and sincere these subjective thoughts may well be. For young children learning to speak, suffering from autism present a special problem to their teachers as well as parents as they are faced with the challenge of teaching these unfortunate children how to express themselves through speech. The importance of effective communication cannot be underestimated. Yet teaching students with autism is not an easy task, it requires patience and use of special assistive technology tools to help these children learn how to form words and use them effectively. There are various technologies that can be used, while other are simple some of these technology are so advanced and needs extra training to use them. One of the basic technologies that has been used for a number of years is Picture Exchange Communication Systems (PECS ) studies have indicated that this technology improves communication of children with autism This paper intends to discuss on the use of this assistive technology to educate students with Autism. Introduction People with autism spectrum conditions have impairments in public communication; included in this core impairment is an intricacy with the social emotional reciprocity in addition to nonverbal communication such as gestures, facial expression and eye contact. Regularly, people with autism spectrum conditions have difficulties identifying emotions particularly complex emotions that call for metalizing (jealous, embarrassed, sarcastic) in both themselves and other people. All of these complications can add to challenges in keeping and making friendships and other encouraging peer relationships. WHAT IS ASSISTIVE TECHNOLOGY? Assistive technology tool means any piece of equipment, item, or product system, whether acquired commercially, modified, off-the-shelf, or customized, that is used to maintain, increase, or improve functional abilities of people with disabilities. Assistive technology service directly assists people with a disability in the acquisition, selection, or use of an assistive technology. The Use of Assistive Technology to Educate Students with Autism The theory of mind is one conceptualization used to explain the social impairment in autism spectrum conditions (Golan and Bauminger, 2006). The theory states that people with autism spectrum conditions have an intrinsic disability in terms of recognizing the psychological perspective of others. That is, they have problem imputing emotion, meaning, and intent to other people. Deficits in this part are serious to effective social interaction, to a great extent it is anticipated on knowing what other people are feeling or thinking. Getting to know emotions is one aspect of the capability to take another persons perspective. A number of studies have researched on the interventions to educate individuals with autism spectrum conditions to identify emotions. These comprise social skill instruction (Golan and Bauminger, 2006) and assistive technology interventions. For instance, Bauminger (2006) examined the use of a behavior based intervention to assist in the emotion recognition skills of 15 high responding kids with autism, ages 8 to 17. The intervention involved lessons from a social skill syllabus used in the school setting for 2 to 4 hours per week for 7 months. The lessons comprised of activities such as role play and just plays with a normally developing peer and working on the skills acquired from each weekly lesson with parents at home. The end results showed advancement in the kids emotional ability and knowledge to give examples of difficult emotions. Specially, at post intervention, the partakers with autism were likely to start social communication with their peers and spent a lot of time displaying encouraging social behaviors. In another study, Hadwin, Baron-Cohen, Howlin, and Hill (1996) taught children with autism spectrum conditions to foresee and identify emotions in others using a computer based intervention called the Emotions Trainer. Partakers between the ages of 12 and 20, incorporated in either a control group or an experimental, were diagnosed with either Asperger syndrome or autism. The program comprised of five sections that incorporated asking the user to select the correct emotion out of four options explaining photographed facial expressions, events or situations, and descriptive captions and objects. Picture Exchange Communication Systems (PECS) This is a low technology assistive system created as an augmentative and alternative communication (AAC), where pictures are used in place of words to assist children with autism to communicate because of their problems in speech development. At the initial stage of using PECS, a child is provided with a number of pictures of favorite toys or foods. If the child requires any of these things, he simply gives the picture of the specific item to a therapist, teacher or even caregiver (Charlop-Christy, et al. 2002). The person receiving this picture in return hands the toy or food to the child. Through this exchange, communication is then strengthened. Similarly PECS can as well be applied to make suggestions regarding things viewed or heard within the surrounding. For instance, a student might view a car passing by and give a picture of a car to his teacher. The objective of this method is that, when a child starts to acknowledge the importance of communication, the child will start using natural speech instead of pictures. How this assistive technology works A student with autism can be taught how to use this technology by his teacher, caregiver or a therapist, who understands the way this technology works. Normally, an applied behavior analysis (ABA) method is applied. Through this method, prompts are offered to control the picture exchange. More so, in the initial stages of PECS training, the student selects a picture he wants and gets what is on the picture, for instance food. Receiving food is meant to give a positive reinforcement to the student for his use of the picture in communicating. Normally PECS training entails six stages: Stage I: the teacher lists down a list of the students favorite items normally starting with foods. A single item from the list is chosen for the opening training lesson, and items picture is drawn. The item can be put in a place visible to the student, to allow the student to view the item but not to pick it. When the child seems interested in the item, the teacher gives such a student a picture card of the item. The teacher guides the students hand to pick the picture and give it to the teacher. The moment the teacher receives the card from the student, he communicates loudly the want the student wants, for instance, he say so you want the cake and give the cake to the child. Stage II: the teacher moves a little distance in order for the student to move towards him to give the picture card to the teacher. Stage III: the student is provided with several picture cards so that he can choose the one representing what he wants. The selected picture card is given to the teacher, at this moment; the student may use a binder or a communication board where the cards will be held. Stage IV: at this point, the student is provided with a card written on I want____. The student has to use this card together with the picture card illustrating what is wanted. The concept is that the student will learn the way to communicate through complete sentences. Those students who can not read the words can be in a position to recognize the words written as symbols on the card. Stage V: prior to this stage, the student has never been directly what he wants, at this stage, the teacher asks the student directly what he wants, and then waits for the student to select a picture representing what the students wants. This lesson builds the basis for future communication between the student and the teacher when the teacher wants to find out what the student wants. Stage VI: the moment the student is able to fluently use PECS, and has managed to generalize the system to use it to communicate with other people apart from the teacher; the student is taught the way make suggestions on something that he has observed. The teacher picks up something interesting and asks the student to say what the item is. At that stage the teacher also picks a card with I see _____. The student is to match the card with what he is seeing. In this manner, the child is able to learn how to communicate what he observes together with his experiences to other people (Charlop-Christy, et al. 2002). Theory behind this technology The express reinforcement coming from immediately receiving what a student with autism is the main principle of PECS. A student is able to show his inner wishes without speaking any words, and be rewarded. Such tangible rewards greatly reinforce such a child compared to social rewards, particularly during the initial stage of communication. PECS could as well improve the social relations of an autism child. This is because the child is able to learn to initiate communication; more so, at this point the child is not expected to speak, so the child is less intimidated. How effective is the technology A number of studies carried out have indicated that PECS is useful tool in helping children with autism. For example, a study carried out by Schwartz, et al. (1998) on eighteen preschool students suffering from autism and with speech difficulties established that those children were able to communicate through PECS in their school days. However, after a training of one year, nearly 50 percent of these children stopped to use PECS and instead began to natural communicate (Schwartz, et al. 1998). More studies supporting this observation were found by (Charlop-Christy, et al. 2002). generally, evidence from a number of studies have established that PECS assistive tool is an effective technique in developing natural speech in children suffering from autism, particularly if they are taught how to use this tool when is below six years of age (Bondy, 2001). Side issues This technology has no known side effectives to children with autism. Though a number of parents showed concerns that their children could end up depending on PECS as their communication tool, and fail to develop their natural speech, this concern lacks any credible support from studies. On the contra, there is credible evidence showing that children suffering from autism are able to learn through PECS to develop their speech quicker compared to those who have not used PECS (Bondy, 2001).
